The Legal Intelligencer has named a case argued and won by Donaghue & Labrum as number 11 of 20 of the Top Pennsylvania Verdicts of 2016. Types of cases represented in the list include medical malpractice, civil rights, motor vehicle, and employment litigation.
Delaware County Lawyers Successfully Argue Medical Malpractice Suit
Hugh Donaghue, founding partner of law firm Donaghue & Labrum, and co-counsel Frank Curran, successfully argued for the plaintiff, Darlene Hill, who was found to have undergone an appendectomy in error and suffered subsequent complications from that surgery which have left her incapacitated. Mr. Donaghue secured a nearly $6 million award against defendants Crozer-Keystone Health System and Southeast Radiology Ltd.
Ms. Hill, who was a 31-year-old nurse at the time of the incident, went to the Emergency Room at Taylor Hospital in Ridley Park due to severe abdominal pain. She was given an X-ray, but a film from another patient was mistakenly labeled with Ms. Hill’s name, and an incorrect diagnosis was observed from that film. The prosecution asserted that the radiologist should have known that the film did not belong to the plaintiff, as she had previously had her gallbladder removed, and the patient in the film had an intact gallbladder.
Based on the X-ray in question, immediate surgery was recommended as a life-saving measure. However, Ms. Hill’s surgeon was unable to locate the issue indicated on the film (or any other). He opted to remove her appendix anyway.
Several months later, Ms. Hill began experiencing severe pain at the site of the incision, and the subsequent investigation revealed that her appendix was removed in error. She was later diagnosed with a nerve condition which eventually caused total medical disability. She is now unable to live alone, walk without the assistance of a cane or scooter, and she is unable to cook, dress, or shop for herself. Needless to say, she is also unable to work.
A Verdict In Favor of A Medical Malpractice Victim
The jury awarded the victim $6 million in compensation for past medical expenses, future medical expenses, past lost earnings, and future lost earnings capacity. This impressive decision for Ms. Hill was one of the top Pennsylvania verdicts last year.
Mr. Donaghue was grateful for the chance to present this case on behalf of the victim. “Medical malpractice cases are among the most heartbreaking, because victims suffer at the hands of the very person who was supposed to take care of them. In unfortunate cases such as this one, the victim will continue to suffer for the rest of her life. Fortunately, we were able to secure Ms. Hill with a judgment that will allow her to receive the care she needs now and into the future.”
